1. GENERAL
This website www.annashelley.fr is published by Anna Shelley, SARL with capital of 1000 euros, registered with the Registre du Commerce et des Sociétés de Paris under SIRET number: 988 841 227 00016, with registered office at 75 ter avenue de Wagram 75017 Paris. Email address: contact@annashelley.fr The publication director is Anna Shelley Galiegue, in her capacity as managing director.
2. PURPOSE
The purpose of the present conditions is to govern the relationship between ANNA SHELLEY, hereinafter referred to as "ANNA SHELLEY", the seller, on the one hand, and the Internet user wishing to place an order, hereinafter referred to as "the Customer", on the other. These General Terms and Conditions of Sale apply without restriction or reservation to all sales concluded by "ANNA SHELLEY" with regard to the products sold in the electronic catalog of the annashelley.fr website as part of a distance selling system. All orders imply the customer's full acceptance of these general terms and conditions of sale hereinafter referred to as "GTC".
Anna Shelley reserves the right to modify these terms and conditions at any time. The modification will take effect immediately upon publication of the GCS.
3. PRODUCTS
The products offered are jewels and objects made in France, partly in the brand's workshop and partly in a partner workshop. Each piece of jewelry is delivered in an Anna Shelley branded box, accompanied by gift packaging. We inform the Customer that the visuals presented on the site may not perfectly reflect reality, due in particular to variations in screen settings and lighting conditions at the time of shooting. In addition, as the jewels are handcrafted, slight variations in shape, finish or hue (particularly for pearls) may occur from one piece to another. These peculiarities are inherent to handmade work and cannot be considered defects of conformity. The images, texts and descriptions on the site are for illustrative purposes only and do not constitute a contractual commitment. For any request for further information, the customer is invited to contact customer service by email at contact@annashelley.fr. No personalized or made-to-measure jewelry is offered for sale.
Any order implies acceptance of the prices and descriptions of the products available for sale.
4. ORDERS
Orders are placed exclusively via the www.annashelley.fr website. As soon as the order has been registered, the Customer receives a confirmation e-mail containing the essential elements of the order, in particular the order number, the list of products ordered and the detailed price. All data supplied by the customer during the ordering process and the recorded confirmation of this order shall constitute proof of the transaction.
Anna Shelley reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received. The company reserves the right to refuse any order in the event of a previous dispute with the customer. The customer may request a modification or cancellation of the order (in particular the delivery address), provided that the request is made by e-mail to contact@annashelley.fr, before the parcel is dispatched. Such requests will be dealt with as far as possible. Products are offered while stocks last. Stocks are regularly updated.
5. PRICES AND TERMS OF PAYMENT
Prices are quoted in euros, inclusive of all taxes. The prices of goods are those in effect on the day the order is taken. Anna Shelley reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in effect at the time of validation of the order and subject to availability. Products remain the property of Anna Shelley until full payment has been received.
Payment must be made in full when the order is placed, using the following methods:
- CB, VISA, MASTERCARD
- PayPal (immediate payment or payment in 4 instalments)
International orders may be subject to import fees, duties, taxes, or other charges imposed by the receiving country. These fees are established by the client's country's government in accordance with import and export regulations and will be charged by the shipping company. Anna Shelley is not responsible for these fees, which will be the responsibility of the recipient of the package.
6. DELIVERY
Deliveries are made by :
- Colissimo with signature for France (estimated delivery time: 24 to 48 working hours)
- DHL for Europe and international deliveries (estimated delivery time: 24 to 48 working hours).
Orders are dispatched within 24 to 48 working hours after validation of payment. A tracking number is sent to the customer upon shipment. Anna Shelley cannot be held responsible for delays caused by carriers. Products are carefully packaged in the brand's boxes.
7. RIGHT ON WITHDRAWALS AND RETURNS
In accordance with article L221-18 of the French Consumer Code, customers have 14 days from the date of delivery to exercise their right of withdrawal. Returns must be notified by email to contact@annashelley.fr within this period, specifying the items concerned and the reason for return. Products must be returned in their original condition, complete (accessories, case, packaging, etc.), unworn, undamaged and clean. Return shipping costs are at the customer's expense. The Customer remains responsible for the shipment of the item until it is received by the Company, at the Customer's own risk (the Customer is therefore advised to declare the value of the goods and to take out insurance covering these risks).
In the event of an error attributable to the company (defective product or preparation error) within this 14-day period, Anna Shelley will send the purchaser a prepaid transport voucher, which must be attached to the parcel.
If the above-mentioned conditions are met, Anna Shelley will reimburse the purchaser for the order, excluding delivery costs, upon receipt of the returned products. Products returned in an obviously abusive or damaged manner will not be taken back or refunded. In this case, they will be kept at the customer's disposal for 14 days. Products on sale cannot be returned or exchanged.
8. LIABILITY
Anna Shelley cannot be held responsible for damage resulting from misuse of the product. In the event of customs duties or local taxes upon importation, it is the responsibility of the purchaser to obtain information from the local authorities and to take charge of any formalities and payments. No reimbursement will be made in this respect.
9. WARRANTY AND AFTER-SALES SERVICES
Anna Shelley jewelry comes with a one-year commercial warranty from the date of purchase, covering manufacturing defects. In order to claim this warranty, the customer must provide proof of purchase. Repairs due to manufacturing defects will be carried out free of charge during the warranty period. After this period, or in the event of natural wear or damage caused by misuse or lack of maintenance, repairs may be proposed on the basis of an estimate, subject to technical feasibility. 10. INTELLECTUAL PROPERTY RIGHTS
All elements on the www.annashelley.fr website - including texts, visuals, photographs, logos and jewelry models - are the exclusive property of Anna Shelley or are subject to an exploitation right. Any reproduction, distribution, exploitation or use without prior express authorization is strictly prohibited and may be prosecuted.
11. PERSONAL DATA
The personal data collected is strictly necessary for the management of orders, deliveries, customer service and the sending of newsletters. This data is processed in accordance with the General Data Protection Regulation (RGPD). It is never passed on to third parties for commercial purposes. They may be transmitted to strictly authorized service providers, such as:
- Payment service providers (PayPal, Stripe)
- Logistics providers (preparation and delivery)
- Marketing service providers acting on behalf of Anna Shelley.
All reasonable precautions are taken to limit the risks of loss, fraudulent use, unauthorized access or modification of personal data. Users may unsubscribe from the newsletter at any time via the unsubscribe link in each email.
12. APPLICABLE LAW
These GTC are governed by French law. In the event of a dispute, an amicable solution will be preferred. Failing this, the French courts shall have sole jurisdiction.
